TERMS AND CONDITIONS

Organizer: This Program is organized by Samsung Malaysia Electronics (SME) Sdn Bhd (“Samsung”).
Samsung’s server is the official time-keeping device for this Program. Samsung reserves the right to amend or extend the duration or any particular of this Program at any time as they deem fit without any prior notice
Contest Period: 7 December 2023, 10:00 am – 11 December 2023 23:59pm
Eligibility. The Contest is open to individuals who:
- Are residents of Malaysia, 18 years of age and above (as of 29 November 2023 as stated in their NRIC) except the employees of the Organizer, their affiliates and/or related companies, distributors, retailers, advertising and promotion agencies;
- A user of any Samsung Galaxy device;
- Have registered for a valid Samsung Account ID and uses Samsung Members. Samsung Accounts are free, but subject to Terms and Conditions. If you do not have a Samsung Account, visit account.samsung.com and follow the links and instructions to create an account;
- Agree to receive promotional and marketing materials about Samsung and/or partner products, services, and/or event through the contact details provided herein. Proof of agreement may be requested. (Hereinafter referred to as “Eligible Participant(s)”)
By participating in this Program, each Eligible Participant agrees to be bound by these Terms and Conditions. All rules and regulations and instructions issued by Samsung from time to time will be deemed incorporated in these Terms and Conditions. Samsung reserves the right to amend the Terms and Conditions at any time, without prior notice.

6. Participation Mechanism:

To participate, an Eligible Participant must first agree to the Terms and Conditions of the Samsung Members questionnaire program.
The Eligible Participant will proceed to share the relevant details in the answer boxes provided.
The Eligible Participant will be required to key in their state of residence, age, and answer 1 questions: What does BTS mean to you?
The winner(s) will be chosen based on the most creative answer

7. Judging Criteria

A total of Seventy (70) participants with the mosy creqtive answer will win one (1) admission ticket to B Verse (BTS, Singing the Stars) Exhibition. The list of recipients will be announced on the Samsung Members app.
Samsung’s decision will be final. No correspondence or further claims shall be entertained.
All entries must meet the Eligibility requirements and fulfill the conditions stated in the “How to Participate” rules. If it is found to be not valid, your entry will be deemed as null and void.

8. Multiple entries by Eligible Participant is allowed. However, only 1 entry from all Eligible Participants, whom answered correctly and followed the required steps in Clause 6 above, will be in the running to be selected as the winner. Samsung reserves the right to disqualify submission(s) from Eligible Participants that are deemed inappropriate or against the Terms and Conditions stated here.

9. Samsung reserves the right at its discretion to approve or reject any submission and/or details submitted to Samsung which are not legible and fraudulent. For the avoidance of doubt, Samsung reserves the right, as it deems fit to determine if the supporting details are sufficiently legible and/or genuine.

10. The prize(s) will be announced together with the Contest and the relevant timeline. Samsung shall at its’ sole discretion, determine the shortlisted participants and thereafter, winners. Picture(s) of the Prize(s) shown in any advertisement, promotional, publicity and other materials relating to or in connection with this Contest is/ are solely for illustration purposes only and may not depict actual color, model or specification of the Prize(s) and does not include any optional accessories. Samsung is entitled to change the specification and color of the Prize(s) without prior notice.

11. Samsung reserves the right to change or substitute the prizes to other prizes of a comparable or other value if deemed fit. Prizes are not exchangeable for cash, non-transferable or refundable.

12. Samsung reserves the right to appoint a third party (3rd) party vendor or service provider to handle the fulfilment or making available of the Prizes and delivery of the Prize(s) to Winners. By providing your personal information including name, delivery address, contact numbers, email address and other information to Samsung, Samsung can use and/or disclose to such third party (3rd) party vendor or service provider for the purposes of delivery service.

13. The winner(s) will be announced through a community post on Samsung Members and receive a direct message from Samsung in their community inbox. Kindly ensure your Samsung Account is valid and reachable by Samsung.

14. At Samsung’s request via email / message through their community inbox, the winner(s) will have to provide Samsung with details for verification and delivery purposes. Winning email / message that are not replied to within three (3) days, will be considered as prize unclaimed. Any prize unclaimed will be forfeited and deemed to have lapsed unconditionally and irrevocably. The winner whose prize has been forfeited or unclaimed shall not be entitled to any payment or compensation from Samsung.

15. Eligible Participants will only be confirmed as winners after the verification of validity of each participation. Samsung reserves the right to check the validity of any participation. Entries failing to comply with the Terms and Conditions herein will not be accepted. Samsung reserves the right to disqualify any Eligible Participant suspected of fraud, or if Samsung believes that the Eligible Participants’ entry and/or results has been manipulated in any way by machines or computers.

16. Delivery will be made within Malaysia only, Samsung reserve the right to refuse or disqualify or reject users who key in wrong information or addresses in other countries.

17. Samsung shall not be held responsible for lost deliveries resulting from wrong information entered by Winners.

18. Except where expressly provided herein, each Eligible Participant shall bear his/her own costs and expenses incurred and/or arising from his/her participation in this Contest, and no reimbursement may be sought from Samsung and/or the sponsors.

19. Where relevant, Samsung will not be responsible for Winner’s transportation that are incurred to utilize the Winning Prize. All personal costs and/or any other costs, fees and/or related expenses that are not relevant to the Contest are the sole responsibility of the Winners.

20. Samsung shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) for personal injury which is suffered or sustained as a result of participation of the Contest.

21. By participating in this Contest, each Eligible Participant is communicating with Samsung electronically. By doing so, each Eligible Participant agrees to receive communications from Samsung electronically. Samsung will communicate by push message via Samsung Members, electronic mail at the electronic mail address provided by the Eligible Participant or posting notices in such manner specified herein. Each Eligible Participant consents to receiving electronically, all agreements, notices, disclosures and other communications that Samsung provides in relation to the Contest. Notwithstanding any provisions herein, each Eligible Participant acknowledges that Samsung have the discretion, but is not obliged, to contact the Eligible Participant via other reasonable means or mode of communication as they deem fit.

22. Each Eligible Participant agrees to take part in any and all marketing, promotional, publicity exercises with respect to this Contest; agrees for Samsung to use his/her name, voice, photograph, likeness or other personal identifiable information in any media for the promotion and publicity of this Contest and/or Samsung products: and grants Samsung all consents and waivers necessary hereunder, including in respect of any promotional photographs and/or audio/video recordings taken in respect of this Contest. Each Eligible Participant agrees that Samsung shall be at liberty to publish, promote, copy, reproduce, transmit, display, edit, adapt, modify, create derivative works of and/or otherwise distribute or use his/her particulars (including any publicly available Facebook profile photo and details):

In connection with this Contest and/or Samsung products;
For the promotion and publicity of this Contest and/or Samsung products;
In any manner, format or media whether now known or hereinafter created, and in any part of the world, including without limitation on online platforms such as Facebook, YouTube, Twitter and Instagram; at Samsung’s sole discretion and royalty-free and without obligation of attribution or consent. Each Eligible Participant hereby irrevocably grants Samsung all consents and waivers necessary in connection with the above.

23. In the event of any dispute arising from this Contest or relating to the interpretation of these Terms and Conditions, the decision of Samsung on all matters pertaining to this Contest shall be final and binding on all parties. No correspondence or further claims shall be entertained.

24. If this Contest is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond Samsung’s control, Samsung reserves the right in its sole discretion, to the fullest extent permitted by law:

To disqualify any Eligible Participant; or
To modify, suspend, terminate or cancel this Contest, as appropriate.

25. Samsung makes no guarantee of the availability of Samsung Members application or its web services and will not be held responsible for any interruption of service that may interfere with the ability to participate in this Contest.

26. Samsung does not undertake any responsibility or obligation to ensure that any prize will be delivered to any prize winner. To the fullest extent permissible under applicable law, Samsung disclaims all warranties and representations of any of any kind, express or implied, including any representation that any prize shall be delivered or transferred to the winner(s). Except for any liability that cannot be excluded by the law, Samsung (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Contest, including but not limited to, where arising out of the following:

Any technical difficulties or equipment malfunction (whether or not under Samsung’s control);
Any theft, unauthorized access or third party interference;
Any claim or prize(s) that is late, lost, altered, damaged or misdirected (whether or not after receipt by Samsung) due to any reason beyond the reasonable control of Samsung;
Any variation to the prize(s) value to that stated in these Terms & Conditions;
Any tax liability incurred by a Eligible Participant; or
Use or claim of the prize(s).

27. Samsung collects, uses and processes and/or discloses (including third party overseas) Participants’ personal information in order to conduct this Contest, and in accordance with the Samsung Privacy Policy (www.samsung.com/my/info/privacy.html). Each Eligible Participant consents to such collection, use, processing and disclosure of his/her personal information and represents and warrants that all information provided is true and accurate in all respects. Validity of enrollment is conditional on providing this information. Each Eligible Participant agrees that Samsung may, for a reasonable period of time, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or making phone calls to the Participant(s).

28. Each Participant agrees to indemnify and hold Samsung harmless from and against any and all claims, damages, liabilities, costs and expenses (including legal costs on an indemnity basis) arising from the alleged or actual infringement of any third party copyright, patent, trademark or other intellectual property rights, or other rights, any breach of these Terms and Conditions and/or arising out of or in connection with this Contest.

29. Each Eligible Participant shall not, without the prior written approval of Samsung, speak to the press or any other media, or give any interviews or comments relating to this Contest.

30. Samsung reserves the right to use any personal data of Eligible Participants in any manner as mentioned above and/or for any purpose they deem fit for the purposes of this Contest and the Eligible Participants are deemed to consent to such use with no monetary payment.

31. The decision of Samsung in relation to every aspect of this Contest, including but not limited to the Eligible Participants shall be deemed final and conclusive under any circumstances and no appeal or complaint from any Eligible Participant will be entertained.

32. Samsung reserves the absolute right to cancel, terminate or suspend the Contest with or without any prior notice and/or assigning any reason. For the avoidance of doubt, cancellation, termination or suspension by Samsung shall not entitle the Eligible Participant to any claim or compensation against Samsung for any and/or all losses or damages suffered or incurred as a direct or indirect result of the act of cancellation, termination or suspension.

33. These Terms and Conditions shall be governed and construed in accordance with the laws of Malaysia, and each Eligible Participant irrevocable submits to the non-exclusive jurisdiction of the courts of Malaysia.

IMPORTANT INFORMATION

All visitors must present E-tickets and redeem entrance passes / wristbands and collect free gifts at the exhibition venue at least 15 minutes or maximum 1 hour before the booked time slot.

To prevent misuse of tickets by others, do not share copies of photos of your E-tickets / QR Codes with anyone or on social media.
This immersive exhibition journey should take approximately 75 to 90 minutes to complete.
Flexi tickets are only valid on the date selected by the visitors and subject to availability of the earliest possible time slot, without time restriction. Last entrance is at 8:40pm.
Each ticket is valid for a ONE (1) time admission only and shall follow the booked time slot strictly. Re-admission is strictly not allowed.
To avoid disappointment, exclusive merchandise can be pre-booked via authorised / official website with 50% deposit payment. Pre-booked merchandise can only be collected during the day of your visit upon payment of the remaining balance before collection.
No exchange, refund, replacement and/or extension of tickets/merchandise will be made under any circumstances.

Free admission for children aged 5 & below. Children aged 12 and below must be accompanied and supervised by an adult at all times. In the event that the behaviour of the children causes disturbance to other visitors, Seni Jaya reserves the right to remove you from the Exhibition.
Please ensure that the ticket purchased by yourself is not shared with any other third party.
For those who purchased on behalf of your friends/family, please ensure that the ticket is issued to the right person.
For multiple tickets purchased, you are solely responsible for all tickets under your purchase.
In the event of any change of the identity cards submitted during the online purchase, the current valid identity card must be produced before Ticket2u customer service agent or any such authorised personnel in order to be registered, Ticket2U/Organiser’s customer service reserves the right to request for further confirmation or documents to verify the ID of the purchaser or persons under the multiple tickets. In the event that the confirmation or documents are insufficient to verify the ID of the purchaser, Ticket2U/Organiser ground floor staff reserve the absolute right to refuse entry to the Exhibition.
The purchaser must be able to show, for registration purposes, the e-confirmation verification sent to the purchaser and a clear soft copy of the identity card submitted online during the ticket purchased online. On-ground access control procedures and methods are bound by the Terms and Conditions of sale specified herein and any other provision as may be specified from time to time.
All visitors must redeem entrance passes at the exhibition venue at least 15 minutes or a maximum of 1 hour before the booked time slot. All visitors shall collect their free gifts from the entrance to the Virtual Reality room, unless otherwise informed by the organiser. Only one (1) set of free gifts per visitor and no exchange and/or replacement will be given for such free gifts. Visitors shall be responsible for their own free gifts once distributed by the organiser.
Guests who arrive more than 15 minutes after the entry time on their ticket are not guaranteed access at the moment of arrival. We will do our best to accommodate you as capacity allows in the next available entry group after we have granted access to all ticket buyers. However, in the event that there are no available slots in the following groups, there shall be no refund and/or compensation provided to such visitors.
Purchasers MUST show their original identity card and confirmation email with a QR code upon ticket collection. In the event the confirmation or documents provided are insufficient to verify the ID of the individual and/or purchaser, the organiser reserves the absolute right to refuse such individual access/entry to the Exhibition.
A valid QR code ticket must be produced to access the Exhibition. Removing any part of and/or altering and/or defacing the QR code may invalidate the ticket. The ticket or E-ticket is non-refundable, not for resale, non-replaceable if lost or stolen, and will not be valid if it is altered or damaged. The organiser reserves the right to cancel such ticket if found resold.
Third parties are not allowed entry to the Exhibition.
In the case of duplicate access on the event day, visitors are required to show proof of purchase, if the visitor is unable to provide sufficient evidence, no entry will be allowed by such visitor.

Each ticket is for ONE-TIME ADMISSION ONLY according to the date and time slot chosen.
Purchase from Unauthorised Sources / Refusal of Admission:

Exhibition tickets may only be purchased at the designated Ticket2U website (“Website”). Any ticket(s) purchased from any other source may be unauthorised copies and purchaser(s) may be refused entry to the Exhibition.
In the event that the purchaser provides false or incorrect data when making the purchase, the purchaser may be prevented from entering the Exhibition.
Ticket2U/Organiser reserves the right, without refund of any amount paid, to refuse the admission to, and/or eject any person whose behaviour does not comply with the rules and regulations set forth by us and/or the venue.

16. Delay & Postponement

Ticket2U does not allow any exchange or cancellation of tickets under any circumstances and tickets sold are neither transferrable nor refundable unless otherwise permitted under the paragraph below.
In the event of postponement, the ticket purchased for the original booked date and time may be applicable and valid for the next available date and time unless otherwise notified.
The Organiser reserves the right to postpone, cancel, interrupt or stop the event due to any causes beyond its reasonable control.

17. Ticket2U/Organiser reserves the right to change or amend any terms and conditions at any time at its sole and absolute discretion without prior notice.

18. For any Pre-Booked Merchandise authorised/official website, visitors shall be required to pay a deposit of 50% of the price of such Pre-Booked Merchandise at the time of purchase. Visitors are also required to pay the remaining 50% of such price before collection of such Pre-Booked Merchandise on the date of the booked slot of the Exhibition ticket. In the unlikely event that the visitor is unable to collect and/or pay for such Pre-Booked Merchandise on the date of the booked slot, such visitor shall make the collection and final payment within seven (7) working days from the date of such booked slot of the Exhibition ticket. If such Pre-Booked Merchandise is not collected within the timeline above, the deposit paid shall be forfeited and there shall be no compensation towards the visitor for the above, for any reason whatsoever.

19. All Merchandise purchased in relation to the Exhibition (both pre-booked or at the Exhibition) shall not be refundable or exchangeable under any circumstances.

EXHIBITION TERMS & CONDITIONS

Prohibited Activities / Items
1. While at the exhibition hall, visitors must NOT:
  - Offer or display any goods or services for sale.
  - Distribute any printed or recorded material.
  - Bring any flag, banner or signage.
  - Play any music or sound, except via personal earphones.
  - Engage in any unsafe act or impede the operation of the exhibition.
  - Smoking or vaping.
  - Cause any disturbance to other visitors
  - Cause any damage to the exhibition materials.
  - The use of cameras, phone cameras, flashlights, tripods and selfie sticks is prohibited in the entire exhibition area, and photography & videography are not allowed in the exhibition areas except at the photo booth provided. Please abide by the regulations of each area of the exhibition and as instructed by our ushers, and respect the intellectual property rights of the artists and the copyright of the works.
2. The following are not be brought into the exhibition hall:
  - Pets
  - Outside food and beverage, except for bottled water.
  - Glass containers.
  - Illegal, hazardous, sharp or combustible items.
  - Transport devices with wheels (except wheelchairs), including but not limited to skateboards, scooters, in-line skates or shoes with built-in wheels.
  - Remote-controlled devices and unmanned aerial vehicles (drones).
  - Suitcases, coolers or backpacks, with or without wheels at any size.
  - Folding chairs.
  - Weapons or items that appear to be used as weapons.
  - Face coverings, except for religious or medical purposes, or face masks.
  - Items (including clothing) with language or imagery offensive to the general culture of Malaysia.
Safety, Security and Comfort
1. By entering visitors accept that they have a duty to take reasonable steps to ensure their own safety and belongings, taking into account any personal medical conditions. All visitors in and around the exhibition should behave in a safe manner at all times and accompanying adults shall exercise reasonable steps in supervising the children.
2. We reserve the right to carry out bag inspections for all visitors.
3. No food or beverages are permitted once you’ve entered the exhibition with the exception of closed plain water bottles.
4. In the event that the Visitor causes damage to any part of the Exhibition and/or the Exhibition materials, the visitor shall be fully liable for all such damage.
5. We reserve the right to refuse admission to or remove from the exhibition, any visitor who contravenes these T&Cs without any refund and/or compensation of any kind.
6. Unruly, disruptive or offensive behaviour and profanity is strictly prohibited and will not be tolerated. Violators may be asked to leave the B*Verse Exhibition without a refund or compensation of any kind.

3. Disclaimers

Organizer of the exhibition reserves the right to change any aspect of operations, including maintenance, renovation or private events. Events are subject to postponement or cancellation; if such events are organised by organizer, it will try its best (but is not obligated) to notify visitors who have made prior registration for such events.
The organizer shall not, in any event be liable for any death, injury, damage or loss howsoever caused within exhibition area.
Organizer will not be responsible for any lost, misplaced or stolen belongings.
The Virtual Reality headset may cause nausea or discomfort for some individuals and visitor’s discretion is advised. Visitors may opt out of wearing the Virtual Reality headset and enjoy the experience via the screen in front. By wearing the Virtual Reality headset, you agree to assume all risks and hold harmless the organiser from any liability for any damages or injuries that may result from its use. In the event that visitors damage the Virtual Reality headset, such visitors shall be liable for all damage that occurred to the maximum liability of the market price of a Virtual Reality headset of the same make and quality.
The Exhibition contains flashing lights which may trigger seizures or other adverse reactions in individuals with photosensitive epilepsy or other medical conditions visitor’s discretion is advised.

PRIVACY POLICY

Ownership or possession of the ticket for the Exhibition does not confer any rights (by implication or otherwise) on the purchaser to use, alter, copy and/or otherwise deal with any of the symbols, trademarks, logos and/or intellectual property appearing on the ticket.
Information is collected from those registering with Ticket2U in order to facilitate ticket or other services available. The information collected and used in accordance with our Privacy Policy.
The information collected from those registering with Ticket2U in order for marketing promotion will be processed in accordance with the Personal Data Protection Notice Policy. By registering, the Registrant provide his/her consent to Ticket2U / Exhibition organiser in processing their information and permits sponsors, partners and/or authorised parties to contact the purchaser to receive marketing materials and communications for future events, promotions and any other marketing and promotional activities.
